Terms of service
These General Terms and Conditions govern the use of the online store Westmount Toronto and every purchase agreement concluded between the entrepreneur and the consumer. Please read them carefully before placing an order.
Article 1 – Definitions
- Entrepreneur: MerijnvEekhout, operating the online store Westmount Toronto.
- Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession and who enters into a contract with the entrepreneur.
- Contract: the distance contract concluded between the entrepreneur and the consumer for the sale of goods.
- Website: the online store operated under the name Westmount Toronto.
- Business day: Monday to Friday, excluding public holidays and weekends.
Article 2 – Identity of the entrepreneur
Article 3 – Scope
These terms apply to every offer made by the entrepreneur and to every contract concluded at a distance between the entrepreneur and the consumer. Before the contract is concluded, the text of these terms is made available to the consumer in a manner that allows it to be stored in a durable form. By placing an order, the consumer confirms acceptance of these terms.
Article 4 – The offer
All offers on the Website are without obligation and valid while stocks last. Products are described as accurately and completely as reasonably possible. Where product images, colours or dimensions are shown, these are indicative and minor deviations do not entitle the consumer to cancellation or compensation. Obvious errors or mistakes in the offer do not bind the entrepreneur. All prices are stated in Canadian dollars (CAD).
Article 5 – Conclusion of the contract
The contract is concluded at the moment the consumer accepts the offer and satisfies the associated conditions by completing the checkout process. The entrepreneur will confirm receipt of the order without delay by email. The entrepreneur may, within legal limits, verify whether the consumer is able to meet their payment obligations and may refuse an order or attach conditions to it, stating reasons.
Article 6 – Right of withdrawal
The consumer may cancel the contract without giving reasons within 14 days of receiving the goods. To exercise this right, the consumer must notify the entrepreneur by email at info@westmount-toronto.com within the withdrawal period. After notifying withdrawal, the consumer has a further 14 days to return the goods.
During the withdrawal period, the consumer must handle the goods and packaging with care and may only unpack or use them to the extent necessary to assess their nature, characteristics and functioning. The consumer is liable for any diminished value of the goods resulting from handling beyond what is permitted.
Article 7 – Refund in case of withdrawal
Where the consumer exercises the right of withdrawal, the entrepreneur will refund all payments received, using the same means of payment used by the consumer unless otherwise agreed. The refund will be issued within 14 days of the entrepreneur being notified of the withdrawal, provided the goods have been returned or the consumer has demonstrated that the goods have been sent back. No fee is charged for the refund. All refunds are processed in Canadian dollars (CAD).
Article 8 – Customs, import duties and VAT
Orders are shipped to Canada. Where any customs charges, import duties or taxes may apply to an order, these are the responsibility of the consumer unless expressly stated otherwise at checkout. The consumer is advised to consult local authorities for information regarding potential charges before ordering. Prices shown on the Website are in CAD.
Article 9 – Conformity and warranty
The entrepreneur guarantees that the goods conform to the contract, to the specifications stated in the offer, and to the reasonable requirements of soundness and usability. Goods must correspond to what the consumer could reasonably expect. Statutory consumer rights and any applicable warranties apply and are not affected by these terms.
Article 10 – Delivery
The entrepreneur will take the greatest possible care when receiving and fulfilling orders. The place of delivery is the address the consumer provides to the entrepreneur.
- Order cutoff: orders placed before 3:00 PM ET begin processing the same day.
- Processing time: 1 to 2 business days (Monday to Friday, excluding weekends).
- Delivery time: 5 to 10 business days (Monday to Friday, excluding weekends).
- Shipping cost: free delivery on all orders.
Stated delivery times are indicative and are not strict deadlines. The risk of damage to or loss of the goods passes to the consumer at the moment of delivery.
Article 11 – Complaints
Complaints about the performance of the contract must be submitted to the entrepreneur fully and clearly described within a reasonable period after the consumer has discovered the defect. Complaints will be answered within 14 days of receipt. If a complaint requires a longer processing time, the entrepreneur will confirm receipt within that period and indicate when a more detailed response can be expected.
Article 12 – Disputes and applicable law
These terms and all contracts between the entrepreneur and the consumer are governed by the law applicable at the entrepreneur's registered seat, without prejudice to the mandatory consumer-protection rights the consumer enjoys under the law of their place of residence in Canada. Disputes will preferably be resolved amicably before being submitted to a competent court.
